Dutch Regulator Fines Bwin Operator €350,000 for Unlicensed Gambling

The Netherlands’ gaming regulator, known as the KSA, has levied a financial penalty of €350,000 (equivalent to roughly $391,500) against ElectraWorks Limited. This sanction was imposed due to the company’s provision of internet gambling services within the Netherlands via its Bwin.com website.

ElectraWorks, a Gibraltar-based entity responsible for managing the Bwin brand on behalf of GVC Holdings, was discovered to be facilitating online wagering on sporting events, roulette, blackjack, and poker for Dutch participants. These activities remain prohibited under Dutch law. The KSA substantiated its ruling with supporting evidence, including the presence of Dutch language choices for financial transactions on the platform.

Additional proof encompassed the utilization of content in the Dutch language and the registration of a website domain name ending in “.nl”. Despite the anticipated legalization of online gambling under the Remote Gambling Act starting January 1, 2021, the KSA asserts that operators can only provide these services after securing a license and fulfilling stringent criteria. Based on expressions of interest and observations from other nations, the KSA projects the issuance of approximately 90 online gambling licenses.
